Abstract

This article explores the extent to which works generated by artificial intelligence (AI) are, or should be, eligible for copyright protection. It considers two key questions: (a) whether and to what extent human involvement is present in the creation of AI-generat- ed works—an issue closely tied to the concept of originality; and (b) whether we should want such works to be covered by copyright, which grants creators exclusive rights and restricts use by others, even for a limited time. The article concludes that when AI-gen- erated works lack meaningful human involvement, they do not meet the threshold of originality and therefore cannot—and should not—qualify for copyright protection.
